Terms of Service
The terms that apply to your use of CareLink Home.
1. About CareLink Home
CareLink Home is a subscription-based care record application for families, whānau, and carers of people with intellectual disabilities. It is operated by CareLink NZ Limited ("CareLink NZ", "we", "us", "our").
CareLink Home enables you to record, manage, and share care information — including support notes, goals, health records, behaviour support records, and care plans.
2. Acceptance
By creating an account or using CareLink Home, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the service.
3. Eligibility
You must be 18 years or older to create an account. CareLink Home is designed for the New Zealand market and is also available to users in Australia. By creating an account, you confirm that you are 18 or older.
4. Your account
If you sign in with an email address and password, multi-factor authentication (MFA) is required. This is to protect the sensitive care information stored in your account.
If you sign in using a Google or Microsoft account, you are responsible for ensuring that your Google or Microsoft account is properly secured. CareLink NZ is not responsible for any unauthorised access resulting from a compromised third-party account.
Do not share your login credentials. If you need to give others access to a person's records, use the built-in access sharing features — they provide controlled, time-limited, and revocable access. You are responsible for all activity that occurs under your account. If you believe your account has been compromised, contact us immediately at support@carelink.co.nz.
5. Subscription and billing
CareLink Home is a paid subscription service.
- Free trial — new accounts receive 7 days of full access at no charge. A valid payment method is required to start a trial. You will not be charged until the trial ends.
- Active subscription — full read and write access to all features. Subscription is billed monthly or annually depending on the plan you choose.
- Lapsed subscription — if a subscription becomes past-due or is cancelled, your account becomes read-only. You can view all existing records but cannot add new ones. We will never block access to information you have already recorded.
- Cancellation — you may cancel at any time. Access continues until the end of the current billing period. No refund is issued for the unused portion of a billing period, unless otherwise agreed.
- Refunds — we consider refund requests on a case-by-case basis. Contact us at support@carelink.co.nz.
- Price changes — we will give at least 14 days' notice before changing subscription prices. If you have already paid for a billing period, the new price will only take effect at your next renewal. You will never be charged extra for a period you have already paid for.
6. Access roles and sharing
The account owner controls who can access each person's records. The following roles are available:
- Owner — full read and write access; controls all sharing
- Family members / whānau — read and write access, as configured by the owner
- Support workers/Carers — time-limited access granted by the owner, with an explicit expiry date
- Read-only viewers — view-only access via a share link, which expires after 7 days by default
The owner may revoke any access grant at any time.
7. Your data
You own all information you enter into CareLink Home. CareLink NZ is a data processor — we store and transmit your information to provide the service, but we do not claim ownership of it, sell it, or use it for any purpose other than operating the service.
You can export your data or delete your account directly within CareLink Home at any time. You may also do this by contacting us at support@carelink.co.nz.
8. Not medical advice
CareLink Home is a record-keeping and care coordination tool. It is not a clinical system, a medical device, or a substitute for professional advice. Information recorded in CareLink Home does not constitute medical, clinical, behavioural, or legal advice. Always consult qualified professionals for clinical and health decisions.
9. Acceptable use
You must use CareLink Home lawfully and responsibly. You must not:
- Enter deliberately false or misleading information about any person
- Use CareLink Home to harass, harm, exploit, or discriminate against any person
- Attempt to access another user's data without authorisation
- Misuse, disrupt, reverse-engineer, or interfere with the service
- Resell, sublicense, or redistribute access to CareLink Home
- Use the service in a way that breaches any applicable New Zealand or Australian law
You are responsible for any loss or cost we reasonably incur as a result of your breach of these Terms.
10. Accuracy of records
You are responsible for the accuracy and completeness of the information you enter. CareLink NZ is not responsible for decisions made by you or others based on information recorded in CareLink Home.
11. Intellectual property
CareLink Home, its design, branding, code, and all associated materials are owned by or licensed to CareLink NZ Limited. You may use the service for its intended purpose but you must not copy, modify, reverse-engineer, or redistribute it.
Your care records remain your property. CareLink NZ claims no intellectual property rights over information you enter.
12. Service availability
We aim to keep CareLink Home available and reliable, but we do not guarantee uninterrupted access. We may perform maintenance or make updates that temporarily affect availability. We will aim to provide advance notice of planned downtime where possible.
13. Limitation of liability
To the maximum extent permitted by applicable law, CareLink NZ is not liable for any indirect, incidental, special, or consequential loss arising from your use of CareLink Home, including loss of data, loss of income, or reliance on information recorded in the service.
For New Zealand users, nothing in these Terms limits or excludes rights that cannot be excluded under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
For Australian users, nothing in these Terms limits or excludes rights that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010), including any applicable consumer guarantees.
14. Changes to these Terms
We may update these Terms from time to time. We will notify account owners by email of material changes at least 14 days before they take effect. Continued use of CareLink Home after the effective date constitutes acceptance of the updated Terms.
15. Governing law
These Terms are governed by the laws of New Zealand. The New Zealand courts have non-exclusive jurisdiction over any dispute arising from these Terms or your use of CareLink Home.
For Australian users, nothing in these Terms is intended to exclude or limit any rights or remedies you may have under Australian law, including the Australian Consumer Law. Where Australian law applies and cannot be excluded, it will take precedence to the extent of any inconsistency with these Terms.
